True, it cannot be maximized because it's modal, but you can resize it with mouse dragging the lower left corner, can't you?
Yes I now, but every time ? Really ? Windows have a keyboard shortcut "Alt+Space - X" - without maximize button - does not work. A completely different story is dragging the lower left corner or window (no-)frame in Linux = lottery

So if you open the dialog for the first time, resize it and push commit, next time the dialog will be the same as you left it.

You're right, it works, thanks, but still - the maximize button is the better solution. This procedure is not intuitive - unsystematic. "...do not resize it to its maximum, leave somo space on all sides." - nobody knows (like me).
